Draft for counsel review. Not in force.

TrueSit terms of use

Version 0.2, 2026-10-11. Effective date: set at launch. Counsel writes and signs the final text. Nothing here is legal advice.

1. Who these terms bind

These terms are an agreement between DMS Consultation Inc., a California corporation in Los Angeles, California (“TrueSit”, “we”), and:

  • the organization that opens a TrueSit account (the “Organization”);
  • each person the Organization adds as a user; and
  • each Solo subscriber, who is both the Organization and its only user.

They cover the TrueSit phone and watch apps, the web dashboard, the website and the API (the “Service”). An order form signed by both parties wins over these terms where they conflict. The Data Processing Addendum (truesit.ai/legal/dpa), the acceptable use policy (truesit.ai/legal/acceptable-use) and, for Solo web purchases, the Solo subscription terms (truesit.ai/legal/solo-subscription) are part of these terms.

2. Words we use

  • Sit: one recorded sales appointment, from the door to the close or the end of the visit.
  • Homeowner: anyone at a sit who is not the rep, including other household members and anyone at the door during a canvass session.
  • Consent line: the short statement the rep says before recording, chosen by the Organization’s consent table for the appointment’s state.
  • Voiceprint: the voice embedding made from a rep’s enrollment, used only to tell the rep’s voice apart in their own sits.
  • AI output: anything the Service generates with AI: transcripts, speaker names, stages, findings, reasons, summaries, Mentor and Level answers, drafts.
  • Customer Data: recordings, photos, transcripts, AI output and other data the Organization or its users put into or create in the Service.
  • Org admin: a user the Organization lets manage its account.

3. Accounts

  • Users must be 18 or older and give accurate details.
  • Org admins are responsible for the users they add, the roles they give and removing people who leave.
  • Keep sign-in methods safe and tell us at security@truesit.ai if you think an account was used without permission.
  • The Organization is responsible for what happens under its account.

4. Recording with consent

Consent is part of how the Service works: the rep tells the homeowner, the app records when it was said and which version, and the homeowner can ask for the recording to be deleted.

The Organization:

  • keeps its consent table current for every state where its reps work, starting from the default in the compliance kit (truesit.ai/legal/compliance-kit);
  • trains its reps to use the consent step, to say the line before recording, and to follow the acceptable use policy;
  • makes sure consent is obtained where the law requires it, including for live listening by its managers; and
  • answers homeowners’ requests about recordings it holds, with our help.

Each rep:

  • says the consent line where the app asks for it and confirms it in the app only after saying it;
  • stops recording at once when anyone asks, and does not record anyone who refused;
  • tells anyone who joins mid-visit that the visit is being recorded;
  • in a canvass session, says the door line at each door before the conversation is kept; and
  • in a Ride-along sit, uses the line that names live listening.

The Service provides the consent step, the state’s rule from the Organization’s table and a record of what was said. These are tools; they are not legal advice, and we do not decide whether a recording is lawful.

5. Voiceprints

Voice enrollment is optional and is the rep’s own choice. The rep agrees to the voiceprint release before enrolling. A rep who does not enroll uses the Service fully and confirms their voice after each sit with one tap. The Organization may not require enrollment as a condition of employment or penalize a rep who declines. Voiceprints are kept and destroyed as the voiceprint policy (truesit.ai/legal/voiceprint) states; the Organization may shorten the period within the published range but not extend it.

6. Employer duties

Where reps are employees or contractors, the Organization is responsible for:

  • giving the notices of electronic monitoring its states require, and getting acknowledgments where required;
  • giving the notices required where AI is used in employment decisions, and offering a human review where the law requires it;
  • never using AI output as the only basis for hiring, discipline, pay or termination; and
  • reviewing the evidence (the transcript moments behind a finding) before acting on it.

The compliance kit contains templates the Organization may adapt. They are starting points, not legal advice.

7. Acceptable use

Users must follow the acceptable use policy. We may suspend use that breaks it, as section 21 describes.

8. Customer Data

  • Ownership. The Organization owns its Customer Data. Between the Organization and its users, the Organization controls it.
  • Our licence. The Organization gives us a limited licence to host, process, transmit and display Customer Data only to provide, secure and support the Service, and to improve it only as the next point allows.
  • Product improvement. We use the contents of recordings and transcripts to improve the Service only when an org admin turns on the product improvement switch (off by default). We never sell Customer Data and never let our providers train their own models on it.
  • Processing terms. The DPA governs how we process personal information in Customer Data.
  • Export and deletion. Org admins export Customer Data at any time from Settings. After an account closes, we delete Customer Data as the retention schedule states.
  • Data that leaves. When the Organization sends data out of the Service, through exports, downloads, API tokens, webhooks or a CRM connection, that copy is its responsibility. We log each export and download.

9. AI output

AI output is decision support. It can be wrong or incomplete. Each finding links to the transcript moment behind it, and confidence is shown where we have it. Users review the evidence before relying on AI output, and the Organization decides what to do with it.

10. Plans, seats, AI budget and recording hours

  • Each plan includes the features and limits shown at purchase or in the order form. We do not publish prices on the website; the price is in the order form or shown before purchase.
  • Organization plans are billed per seat. Adding a seat is prorated; removing one stops its renewal at the end of the period.
  • Each organization has a monthly AI budget. When it is used up, new Level questions, Quick recaps and practice sessions wait until the next month or until the Organization adds budget. Recording never stops.
  • Recording hours are pooled across the Organization’s seats each month. Past the pool, new sits are kept safely but wait to be processed until a seat is added or the month turns. Recording never stops.
  • If the Organization stops paying or a trial ends, the account becomes read-only: recording and processing continue, while invitations, playbooks and settings are locked until payment.

11. Renewal and cancellation

  • Subscriptions renew automatically, monthly or yearly, as shown before purchase, until cancelled.
  • Cancel online in the same place you bought: the billing page for web purchases, or the app store for store purchases. Cancelling stops the next renewal; access continues to the end of the paid period.
  • Before a yearly plan renews, we send a reminder with the date, the amount and how to cancel.
  • We give at least 30 days’ notice before a price change takes effect, and the new price applies from the next renewal.
  • A trial converts to a paid plan only on the terms shown when it started.
  • Purchases through the Apple App Store or Google Play follow that store’s rules for billing, renewal and refunds.

12. Refunds

Fees are not refundable except where the law or an app store’s rules require it, or where we end the Service for our convenience (we then refund the unused prepaid part).

13. Availability and support

  • We work to keep the Service available but do not promise uninterrupted service unless an order form does.
  • Recordings are stored on the phone until they upload, so an outage on our side does not lose a sit.
  • We announce planned maintenance in advance where it affects use.
  • Support: in-app Help, the help center and support@truesit.ai. We aim to reply within the target set for the Organization’s plan, shown in the order form.

14. Security and incidents

We protect Customer Data as the DPA and the security overview (truesit.ai/legal/security) describe, and notify the Organization of a security incident affecting its data as the DPA states.

15. Other services

Sign-in with Google or Apple, app stores, and the Organization’s own CRM or other systems are governed by their providers’ terms. We are not responsible for them, or for data once it reaches them.

16. Intellectual property and feedback

The Service, the TrueSit brand, our software and our templates belong to us or our licensors. The Organization’s own playbooks and material belong to the Organization. If you send us feedback or ideas, we may use them without obligation to you.

17. Confidentiality

For organization accounts, each party keeps the other’s non-public information confidential, uses it only to perform under these terms, and protects it with reasonable care. This does not cover information that is public, already known, independently developed or lawfully received from someone else, and allows disclosures the law requires with notice where allowed.

18. Warranties and disclaimers

Each party warrants it has authority to enter these terms. The Organization warrants that it has the rights and gives the notices needed for the Customer Data it puts into the Service, including the recordings its reps make. Apart from the express promises in these terms and the DPA, the Service is provided as is, and we disclaim implied warranties to the extent the law allows.

19. Limitation of liability

  • Neither party is liable for indirect, incidental, special or consequential damages, or lost profits or sales.
  • Each party’s total liability is limited to the fees paid or payable in the 12 months before the claim.
  • These limits do not apply to: the Organization’s indemnity for recording and consent claims in section 20; either party’s fraud or wilful misconduct; or amounts owed for the Service.
  • Our liability for a security breach of Customer Data caused by our failure to meet the DPA is limited to [a higher cap agreed with counsel].

The treatment of consent breaches is a question for counsel.

20. Indemnities

  • The Organization will defend and indemnify TrueSit against third-party claims arising from recordings its users made, including claims that consent or notice was missing, and from its users’ breach of the acceptable use policy or its own employer duties.
  • TrueSit will defend and indemnify the Organization against third-party claims that the Service, used as allowed, infringes their intellectual property, and against claims arising from our breach of the DPA’s security duties.
  • The party seeking indemnity gives prompt notice, lets the other control the defense and cooperates.

21. Suspension and termination

  • Either party may end these terms at the end of a subscription period.
  • We may suspend access to stop a security threat, unlawful recording or a serious breach of the acceptable use policy, with notice where practical, and restore it once the cause is fixed.
  • Either party may end these terms if the other materially breaches them and does not fix the breach within 30 days of notice.
  • After termination, the Organization has 30 days to export its data. We then delete Customer Data as the retention schedule states.

22. Disputes

These terms are governed by California law. The state and federal courts in Los Angeles County, California have exclusive jurisdiction, and either party may bring a claim within its limits in small claims court. Before filing, a party sends a written description of the dispute and both try in good faith for 30 days to resolve it.

[Arbitration and a class action waiver are not included. Counsel decides, with a consumer carve-out for Solo subscribers if they are added.]

23. Changes

We give at least 30 days’ notice of material changes to org admins and users, by email or in the app. A change that reduces the Organization’s rights or adds cost takes effect at its next renewal, unless the law requires it sooner.

24. General and contact

These terms, the documents they include and any order form are the whole agreement. Neither party may assign them without consent, except to a successor in a merger or sale with notice. Neither party is liable for delays caused by events beyond its reasonable control. If a provision is unenforceable, the rest stays in force. Notices to us: legal@truesit.ai (to be created) and our postal address (to be set before publication).
